Terms & Conditions
Definitions
“Anam & Co.” refers to Anam Holdings LLC, DBA Anam & Co. “Client” refers to the person or business booking services through Anam & Co. “Services” refer to any hospitality, bartending, event, or consulting offering provided under this entity.
Booking & Payment
All bookings require full payment to confirm the reservation. Invoices are due upon receipt. Unpaid = Unbooked. Tips are not a form of payment and do not apply to booking fees. Accepted payments include card and ACH, processed securely through Heartland, Acuity, or PayPal.
Cancellations & Date Moves
Each booking reserves dedicated time, preparation, and personnel.
• 14+ days prior: 25% refund of the service fee.
• Within 14 days: Non-refundable.
• Date changes: One complimentary date move may be granted if within six (6) months and availability allows; otherwise treated as a cancellation. Applies only to social events (weddings, private gatherings). Restaurant or shift coverage bookings are excluded.
• Last-Minute Bookings: Services booked within seven (7) days of the event are final and non-refundable.
By booking and submitting payment, the Client acknowledges and agrees to all integrated policies.
Service Standards/Protection from Workplace Harassment
Anam & Co. upholds professional, intentional, and ethical conduct at all times.
Anam & Co. and its service professionals are committed to working in environments that are safe, respectful, and free from harassment or any form of toxicity.
Workplace Safety, Anti-Harassment, and Anti-Defamation Clause
Anam Holdings LLC (DBA Anam & Co.) and its service professionals—including, but not limited to, Marissa Quiñonez, Leads, and all staff—are entitled to a safe, respectful, and harassment-free work environment at all times. This expectation extends to all venues, clients, event guests, participants, and staff from other establishments (including line cooks, chefs, business owners, hosts, managers, bussers, servers, and others present during the event or shift).
Harassment, bullying, abuse, intimidation, threats, or toxic behavior—whether physical, mental, verbal, or otherwise—from any individual associated with the event or establishment will not be tolerated. The Client must promptly report any such behavior if witnessed. If an Anam & Co. Lead or service professional experiences discomfort or distress due to a toxic or hostile work environment, they are authorized to remove themselves from the premises immediately, and no refund will be issued in the event of such harassment.
Should any such conduct occur, Anam & Co. reserves the right to immediately terminate services without refund and to pursue all available remedies to the fullest extent permitted by the laws of the State of New York.
Furthermore, the Client, guests, event participants, and staff of other establishments agree not to engage in defamation, slander, or libel—whether in person, in writing, or online—against Anam Holdings LLC, Anam & Co., Marissa Quiñonez, any Leads, service professionals, or associated personnel. Any false or damaging statements intended to harm reputation may result in legal action and pursuit of damages as permitted by law.
This clause is intended to protect the well-being, safety, and professional reputation of Anam Holdings LLC, Anam & Co., and all service professionals. If at any time conditions become unsafe—including harassment, illegal activity, violence, excessive intoxication, or any conduct identified above—Anam & Co. may end service immediately without refund.
Alcohol & Compliance
Unless otherwise agreed in writing, the Client provides and owns all alcohol, assuming all permits and ID compliance. Anam & Co. may refuse service to any guest for safety or compliance reasons.
Tip Compensation and Payment Policy
Tip compensation will be distributed in accordance with house policy. If multiple waitstaff or bartenders serve a section, tips will be shared and distributed per house policy. If only one service professional covers a section and house policy does not require tip pooling, all tips collected will go to the Anam & Co. service professional covering that shift, in accordance with typical industry standards.
Payment for services must be received in full to reserve your shift. Tips are not a substitute for payment. They are a voluntary gesture of guest appreciation and are never to be considered a form of compensation for reserving an Anam & Co. service professional. Tips will be divided among the team or as otherwise agreed, in accordance with house policy.
Booking is confirmed only upon receipt of full payment prior to the commencement of the shift.
Gratuity Policy
All gratuities for Anam & Co. service professionals (“Service Professionals”) shall be paid directly and in full to the individual(s) providing such services, unless an alternative arrangement is expressly agreed to in writing by all parties prior to the event date. By engaging an Anam & Co. Service Professional, the Client acknowledges and agrees that such individual is fulfilling a staffing need in place of the Client’s own personnel for the specified role and is therefore entitled to all gratuities customarily associated with that service.
The Client and/or venue is required to disclose, in writing and in advance of the event, any policy or practice that would prevent or restrict direct payment of gratuities to Anam & Co. Service Professionals. Failure to provide such disclosure constitutes a material breach of these terms and may result in additional fees, withholding of services, or immediate adjustment or termination of the service agreement at Anam & Co.’s sole discretion.
By accepting these terms, the Client affirms understanding and acceptance of this policy in full.
Overtime & Travel
Overtime is billed in one-hour increments and due upon receipt.
• Restaurant shift coverage: $50/hour
• Event services: $100/hour
Travel beyond a 20-mile radius of Amsterdam, NY, may incur additional fees.
Insurance
Anam & Co. carries General Liability and Liquor Liability coverage. A Certificate of Insurance (COI) is available upon request.
Intellectual Property
All materials, language, methods, and tier structures are proprietary. Clients may not copy, reproduce, or distribute Anam & Co.'s intellectual property without written consent.
Limitation of Liability
To the fullest extent permitted by law, Anam & Co.'s total liability shall not exceed the total fees paid for the specific event. No consequential or special damages apply.
Independent Contractor
Anam & Co. operates as an independent contractor. The Client has no control over work methods beyond event outcomes and safety standards.
Force Majeure
Neither party is liable for failure or delay due to events beyond reasonable control (severe weather, illness, outage, or government action). Fees may transfer to a mutually agreed reschedule within six (6) months.
Governing Law
The laws of the State of New York govern this agreement. Amendments must be made in writing (email acceptance permitted).
Severability
If any provision of these Terms & Conditions is determined to be invalid, illegal, or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms & Conditions, together with any written agreements or policies expressly referenced herein, constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
Modification
Anam & Co. reserves the right to update or modify these Terms & Conditions at any time. Any changes will be posted on our website with the revised effective date. Continued use of our services after such modifications constitutes acceptance of the updated terms.
Intellectual Property Notice
All content, materials, language, methods, tier structures, designs, branding, and other intellectual property provided by or associated with Anam Holdings LLC (DBA Anam & Co.) are proprietary and protected under applicable copyright, trademark, and intellectual property laws. No part of this website, its materials, or services may be copied, reproduced, modified, distributed, displayed, or used in any manner, in whole or in part, without the prior written consent of Anam Holdings LLC.
Unauthorized use of any intellectual property belonging to Anam Holdings LLC (DBA Anam & Co.) may result in legal action and pursuit of damages to the fullest extent permitted by law.
